We present behavioral lateralizations of spiders and ants and their probable survival value. They clearly conform to the vertebrate lateralizations reviewed by Vallortigara & Rogers and to earlier arthropod studies. We suggest two complementary reviews: differences in lesion susceptibility and muscle strength between left and right body side, and perceptual biases and predator inspection in invertebrates.

The global financial crisis has led to a surprising interest in professional oaths in business. Examples are the MBA Oath, the Economist’s Oath and the Dutch Banker’s Oath, which senior executives in the financial services industry in the Netherlands have been obliged to swear since 2010. This paper is among the first to consider oaths from the perspective of business ethics. A framework is presented for analysing oaths in terms of their form, their content and the specific contribution they make (...) to business ethics management: oaths may foster professionalism, facilitate moral deliberation and enhance compliance. This framework is used to analyse and evaluate the MBA Oath, the Economist’s Oath and the Banker’s Oath as well as various other similar initiatives. (shrink)

This paper presents an argument for the value of privacy that is based on a purely negative concept of freedom only. I show that privacy invasions may decrease a person’s negative freedom as well as a person’s knowledge about the negative freedom she possesses. I argue that not only invasions that lead to actual interference, but also invasions that lead to potential interference (many cases of identity theft) constitute actual harm to the invadee’s liberty interests, and I critically examine the (...) courts’ reliance on a principle of ‘no harm, no foul’ in recent data breach cases. Using a number of insights from the psychology of human belief, I also show that the liberal claim for protection of privacy is strengthened by the observation that often the privacy invader cannot be held responsible for the influence on the invadee’s negative freedom. This paper argues that liberal freedom (non-interference) is epistemologically prior to republican freedom (non-domination). I start investigate three relations between liberal and republican freedom: (i) Logical Equivalence, or the question whether republican freedom entails liberal freedom (and vice versa); (ii) Degree Supervenience, or whether changes in the degree (amount, quantity) of republican freedom are mirrored by changes in the degree of liberal freedom (and vice versa); and (iii) Epistemological Priority, that is, whether knowledge about arrangements of republican freedom presupposes knowledge (...) about arrangements of liberal freedom. If Logical Equivalence holds, liberals are right to claim that republicans have not introduced a new concept of freedom. It is easy to see, though, that Logical Equivalence does not hold. If Degree Supervenience holds, liberals can maintain that while republican freedom is a new concept of freedom, fostering or promoting it is not very different from fostering or promoting liberal freedom. Degree Supervenience does not hold either, though, and as a result two straightforward counterarguments against republican freedom fail. Yet, I argue, first, that the relation of Epistemological Priority holds: knowing something about arrangements of republican freedom presupposes that you know something about arrangements of liberal freedom. Using Epistemological Priority, I show, second, that the benefits claimed for republican freedom over and above liberal freedom (it minimizes the need for strategic deference, it minimizes uncertainty, and it minimizes subordination) can be accounted for in purely liberal terms. This phenomenological study begins by presenting trust as a characteristic form of interpersonal and communal relationship. In the second chapter, the scope is narrowed to someone's reliance on one or more trustworthy individuals. Chapters 3 to 5 explore specific aspects of trust, insofar as we confide in social structures or movements, the impersonal regularities and events of nature, or our own particular talents, motivations, and possibilities. In a world that is ravaged by the omnipresence of suffering and the most outrageous (...) manifestations of evil, no philosopher can avoid the question of what kind of trust may be profound and strong enough to overcome the ultimate anxiety or despair that threatens all human existence. In the Western tradition of belief, thinking, faith, and searching for the first and ultimate, that question is approached here through reflection upon the radical difference between trust in the universe and faith in God. Although Emmanuel Levinas is widely respected as one of the classic thinkers of our century, the debate about his place within Continental philosophy continues. In his tractA Rationale of Judicial Evidence, Jeremy Bentham repeatedly refers to the courtroom as the ‘theatre of justice’. Bentham's description has been borne out by recent scholarship on Athenian law. As a form of civic space, the Athenian lawcourts were similar to the Theatre of Dionysos in many respects: litigants faced each other in a competitiveagon, delivering lines written for them by logographers to a mass audience which would range, ordinarily, from 200 to 1500 jurors. Moreover, modern scholars have (...) drawn on the notion of ‘social drama’ introduced by the anthropologist Victor Turner to describe the Athenian lawcourts as an arena for socially constructive feuding behaviour, as a public stage for the social élite to compete for prestige, or as a forum for ongoing communication between élite litigants and mass jurors ‘in a context which made explicit the power of the masses to judge the actions and behavior of élite individuals’. Since the truth is only the whole, no statement or discipline can be true unless we understand how it relates to all other statements and disciplines within one encyclopedic knowledge. This theorem also applies to the perspective from which the exposition of the whole truth can be approached. Hegel’s Phenomenology of Spirit, for example, in a sense gathers the entire truth, but its perspective is the specific phenomenological one of experience and Bildung. All partial perspectives taken together, however, understood in (...) the necessity of their unity, form the one and overall perspective—which no longer is a perspective—that constitutes the truth of the truth beyond which nothing exists or can be known. This one and total Idea can be known by us, finite intelligences, only in the unfolding and time-consuming form of a discursive system. Levinas approaches the Infinite as beyond all possible ideas and totalities.

In various publications over the past years, Floridi has developed a theory of semantic information as well-formed, meaningful, and truthful data. This theory is more or less orthogonal to the standard entropy-based notions of information known from physics, information theory, and computer science that all define the amount of information in a certain system as a scalar value without any direct semantic implication. In this context the question rises what the exact relation between these various conceptions of information is and (...) whether there is a real need to enrich these mathematically more or less rigid definitions with a less formal notion of semantic information. I investigate various philosophical aspects of the more formal definitions of information in the light of Floridi’s theory. The position I defend is that the formal treatment of the notion of information as a general theory of entropy is one of the fundamental achievements of modern science that in itself is a rich source for new philosophical reflection. This makes information theory a competitor of classical epistemology rather than a servant. In this light Floridi’s philosophy of information is more a reprise of classical epistemology that only pays lip service to information theory but fails to address the important central questions of philosophy of information. Specifically, I will defend the view that notions that are associated with truth, knowledge, and meaning all can adequately be reconstructed in the context of modern information theory and that consequently there is no need to introduce a concept of semantic information. This article provides an outsider perspective on the scientificity of legal studies. First, I argue that the presence of controversies does not mean that legal studies lack the status of a genuine science. Astronomy, mathematics, and economics have their controversies, too. Second, I show that non-empirical, non-normative research is no less scientific than empirical research. This is illustrated by work in mathematical logic. Third, I demonstrate the same claim for non-empirical, normative research.Here the example is research on social contract theories (...) by means of gametheoretic models. (shrink)

This article argues that attention to the expressive function of law suggests that the Athenian laws prohibiting former prostitutes from active political participation may have had a much broader practical impact than previously thought. By changing the social meaning of homosexual pederasty, these laws influenced norms regarding purely private conduct and reached beyond the limited number of politically active citizens likely to be prosecuted under the law. Some appear to have become more careful about courting in public while others adopted (...) a conception of chaste pederasty that would not run afoul of the law. The prostitution laws may also have provoked resistance among a particular subset of elites, the apragmones, contributing to this group's deliberate disengagement from public affairs. (shrink)

Susan Hurley has argued against a well known argument for freedom of speech, the argument from autonomy, on the basis of two hypotheses about violence in the media and aggressive behaviour. The first hypothesis says that exposure to media violence causes aggressive behaviour; the second, that humans have an innate tendency to copy behaviour in ways that bypass conscious deliberation. I argue, first, that Hurley is not successful in setting aside the argument from autonomy. Second, I show that the empirical (...) data are irrelevant to statutory regulation of media violence. They do not yield a sufficiently strong correlation between exposure to media violence and non-autonomously copied criminal violence, and they do not yield a way ex ante to individuate the viewers who will be affected by media violence. Using epistemic logic, we provide a non-probabilistic way to formalise payoff uncertainty, that is, statements such as ‘player i has approximate knowledge about the utility functions of player j.’ We show that on the basis of this formalisation common knowledge of payoff uncertainty and rationality (in the sense of excluding weakly dominated strategies, due to Dekel and Fudenberg (1990)) characterises a new solution concept we have called ‘mixed iterated strict weak dominance.’.

The classical Athenian 'state' had almost no formal coercive apparatus to ensure order or compliance with law: there was no professional police force or public prosecutor, and nearly every step in the legal process depended on private initiative. And yet Athens was a remarkably peaceful and well-ordered society by both ancient and contemporary standards. Why? Law and Order in Ancient Athens draws on contemporary legal scholarship to explore how order was maintained in Athens. Lanni argues that law and formal legal (...) institutions played a greater role in maintaining order than is generally acknowledged. The legal system did encourage compliance with law, but not through the familiar deterrence mechanism of imposing sanctions for violating statutes. Lanni shows how formal institutions facilitated the operation of informal social control in a society that was too large and diverse to be characterized as a 'face-to-face community' or 'close-knit group'.
